administrative irregularity of people already living in Spain by recognizing situations involving deep-rooted ties, family life, employment, or vulnerability, and by providing greater legal certainty.<\/p>\n\n<p>To this end, the text introduces <strong>two transitional provisions<\/strong> that establish two separate avenues for extraordinary regularization.<\/p>\n\n<h2 class=\"wp-block-heading has-accent-3-color has-text-color has-link-color wp-elements-4a1fae97583bb8622597842717e8b242\">Scenario 1<\/h2>\n\n<p><strong>Regularization of Applicants for International Protection<\/strong><br\/>(Fifth Transitional Provision \u2013 Arraigo)<\/p>\n\n<p><strong>Who is this for?<\/strong><br\/><strong>People who applied for international protection in Spain before December 31, 2025,<\/strong> and are currently in Spanish territory (and will remain in Spain until the application is filed).<\/p>\n\n<p><strong>Applicant requirements<\/strong><br\/> You must:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Be in Spain at the time of application.<\/li>\n\n\n\n<li>You must have no criminal record in Spain or in any countries where you have resided during the past 5 years (except for expungable records, which must be expunged).<\/li>\n\n\n\n<li>Not pose a risk to public order, safety, or public health.<\/li>\n\n\n\n<li>Not be barred from entering Spain or listed as inadmissible in the Schengen Area.<\/li>\n\n\n\n<li>Not being subject to a non-return commitment, if one exists.<\/li>\n\n\n\n<li>Pay the administrative fee.<\/li>\n<\/ul>\n\n<p><strong>Family members included<\/strong><br\/> They can regularize their status with you:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>Minor children.<\/li>\n\n\n\n<li>Adult children with disabilities or who require care.<\/li>\n\n\n\n<li>Other family members who can demonstrate social ties.<\/li>\n<\/ul>\n\n<p>In the case of minor children, the draft exempts applicants from the financial, housing, and time-limit requirements normally required for family reunification.<\/p>\n\n<p><strong>(Tentative) Term<\/strong>:<br\/>Through <strong>June 30, 2026<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading has-accent-3-color has-text-color has-link-color wp-elements-72cd4285955334240ae807cb6423c16c\">Scenario 2<\/h2>\n\n<p><strong>One-time authorization due to exceptional circumstances<\/strong><br\/>(Sixth Transitional Provision)<\/p>\n\n<p>This is the broadest aspect of the project and the one that could affect the most people.<\/p>\n\n<p><strong>Who is it intended for?<\/strong><br\/>Foreign nationals who:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>They were <strong>in Spain before December 31, 2025<\/strong>.<\/li>\n\n\n\n<li>They must have resided in Spain <strong>for at least 5 consecutive months<\/strong> (up to the date the application is filed).<\/li>\n<\/ul>\n\n<p><strong>General Requirements<\/strong><br\/>You must provide proof of:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>A minimum continuous period of 5 months (as evidenced by any means).<\/li>\n\n\n\n<li>No criminal record in the past 5 years.<\/li>\n\n\n\n<li>Not pose a risk to public order or safety.<\/li>\n\n\n\n<li>Not be barred from entering Spain.<\/li>\n\n\n\n<li>Not be subject to a non-return agreement.<\/li>\n\n\n\n<li>Payment of the administrative fee.<\/li>\n<\/ul>\n\n<p class=\"has-accent-8-color has-text-color has-link-color wp-elements-8d6f9a9e33fda547a5394f227e101c5f\"><strong>Additional requirement (only one is required)<\/strong><\/p>\n\n<p>In addition, you must meet <strong>one<\/strong> of the following requirements:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Employment<\/strong>: Must have worked in Spain or provide a contract.<\/li>\n\n\n\n<li><strong>Household<\/strong>: living with school-age children, children with disabilities, or first-degree relatives.<\/li>\n\n\n\n<li><strong>Social vulnerability<\/strong>: certified by public social services or third-sector organizations.<br\/>The project assumes that individuals in an irregular administrative status are vulnerable.<\/li>\n<\/ul>\n\n<p><strong>(Tentative) Term<\/strong>:<br\/>Through <strong>June 30, 2026<\/strong>.<\/p>\n\n<h2 class=\"wp-block-heading has-accent-3-color has-text-color has-link-color wp-elements-113b17c4e51b80322b43e8e8bc7f4d08\">Relevant Common Aspects<br\/><\/h2>\n\n<ul class=\"wp-block-list\">\n<li>Expedited processing.<\/li>\n\n\n\n<li>Suspension of other ongoing immigration proceedings.<\/li>\n\n\n\n<li>Option to submit a sworn statement if the criminal background check from the country of origin is not obtained in time.<br\/><\/li>\n\n\n\n<li><strong>Provisional Residence and Work Permit<\/strong>.<br\/>From the moment the application is accepted for processing:\n<ul class=\"wp-block-list\">\n<li>You may <strong>legally reside and work<\/strong>\u2014whether as a self-employed individual or as an employee\u2014throughout the country.<\/li>\n\n\n\n<li>This authorization remains in effect until a decision is issued.<\/li>\n\n\n\n<li>If the decision is ultimately <strong>favorable<\/strong>, the final authorization is granted retroactively\u2014that is, from the date of the application up to one year later; <strong>if it is unfavorable<\/strong>, the authorization lapses\u2014that is, it is terminated\u2014and the person returns to the same status they had prior to the application.<br\/><\/li>\n<\/ul>\n<\/li>\n\n\n\n<li><strong>Deportation or Return Orders<\/strong>\n<ul class=\"wp-block-list\">\n<li>Filing the application suspends proceedings based solely on unauthorized stay or unauthorized employment.<br\/><br\/><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n<p>And if the decision arrives and it is favorable, the process doesn\u2019t end there.
