One line of law separates them, and it decides whether you’re settled in Spain or settled in Europe

You renewed, or you’re about to. You’re not going for citizenship, so the thing you’re renewing towards is the five-year door — long-term residence. And then someone in your group says the sentence that sends everyone to Google: “there are two of them.”

There are. They’re called long-term residence – national and long-term residence – EU, they sit twelve articles apart in the same regulation, and most of what you’ll read compares them as two procedures. That’s fair, but it answers the wrong question. The useful question is not which one is better; it’s which one is yours, and what do you need to have in place by the time you file — because the two ask for different things, and one of those things takes years, not weeks, to arrange.

Here is the comparison the way we’d walk a client through it: what’s identical, what differs, and what to do about the difference in years two to four.

1. What is identical — and it’s most of it

Both statuses need the same five years of legal, continuous residence in Spain, counted from your first legal day (arts. 176.a) and 183.1). Both live inside the same absence budget: no single absence over six consecutive months, no more than ten months in total across the five years — eighteen months if the absences are for work reasons — and force majeure assessed case by case (arts. 176.a) and 183.2). If you came in on the digital nomad route, that budget is the one from the five-year calendar in our main article, and it’s already counting.

The procedure is the same in both cases (arts. 177 and 184): you file in the two months before your current authorisation expires; filing extends your permit until they decide; a filing up to three months after expiry also extends it, with a sanction file possible; they must resolve in three months; and silence is positive. If you already hold a valid authorisation and already meet the requirements, you don’t have to wait for the window.

Afterwards, the card works the same way: first renewal at five years, then every five until you turn thirty and every ten after that (arts. 178.1 and 185.1). And in both versions, forgetting to renew the card does not extinguish the status (arts. 178.3 and 185.3) — with two small differences worth knowing: the EU article adds that the card obligations still carry their own sanctions, and the national article adds that the office will check the conditions are still met when you come back for it.

Both are lost the same two main ways (art. 201.1): twelve consecutive months outside the European Union — the EU, not Spain — or acquiring EU long-term residence in another member state. Both have a recovery procedure if that happens (arts. 186-189), with a three-month deadline and positive silence. That’s a safety net, not a plan.

So: same years, same budget, same forms, same deadlines, same card, same main ways to lose it. If that were the whole story there’d be no choice to make.

2. What differs — four things, and one of them is the whole point

The national version (art. 182) authorises you to live and work in Spain indefinitely, on the same terms as Spanish nationals. The EU version (art. 175) says exactly the same words — and then adds one clause: that you benefit from the status defined in Directive 2003/109/EC. That clause is not decoration. It’s the status that other member states recognise, and it’s what lets a long-term resident move to another EU country as a resident rather than as a newcomer.

You can see the mechanism from the Spanish side, in mirror image. Article 179 lets a person who holds EU long-term residence from another member state come and live in Spain without a visa, filing before or within three months of arrival, with a decision in two months; article 180 extends that to the family that was part of the household there. Read those two articles as a description of what your Spanish EU status would do for you in Lisbon, Berlin or Dublin — subject to how that country applies the Directive, which is their law, not Spain’s, and which we haven’t examined here.

Two more things the EU version asks that the national one doesn’t (art. 176.b) and c)): fixed and regular resources for you and, where relevant, your family — assessed using the family-reunification yardsticks, and they may come from your own means or from work — and health cover. On this route you had both to get in; the point is that you’ll need to show them again at year five, in the form the regulation wants.

And one difference nobody puts in the comparison tables: time spent on a student stay counts at 50% for the EU version (art. 176.a), while article 183 says nothing about student time at all — and a student stay is legally a stay, not a residence. On the text as written, that means a year as a student before your digital nomad residence adds six months to your EU count and adds nothing to your national count. How offices apply that in a mixed file is something we haven’t been able to verify; if it applies to you, it’s a question to settle before year four, not after.

Finally, the EU version has one extra way to be lost: six years of absence from Spanish territory (art. 201.2). For a person whose plan is to stay, that’s a footnote — but it’s the kind of footnote that matters to someone who takes the EU status abroad and stays abroad.

3. Which one is yours

We’d put it as one question, and we’d ask it in year two, not year five:

Is there any realistic chance — a job, a partner, a client, a child’s university — that you’ll want to live in another EU country in the next ten years?

If the honest answer is no, Spain is the plan, the national version is enough and it asks for less. If the answer is maybe, aim for the EU version, because the two diverge in what they’re worth to you rather than in what they cost to obtain, and asking for the other one later means a new procedure, not a field on a form.

Two situations where we’d slow down before saying “EU”:

A spouse or partner who doesn’t work. The EU article asks each applicant for resources that are theirs, “from own means or from work”, measured with the reunification yardsticks. Whether the working spouse’s income counts as the non-working spouse’s own means for this purpose is not something we’ve been able to verify. For the family member, the national version may be the safer door — or it’s a conversation. We’ve kept that for its own article.

Anyone who arrived as a student first. The 50% rule above cuts both ways. Count your years twice, once for each version, before you assume you reach five.

4. What to have in place by year four

The reason to decide early is that the EU requirements are not things you produce in the filing window. In years two to four:

Keep the resource trail clean and regular. The word in the article is regular: steady income evidenced over time reads better than a large balance on the day.

Keep the cover continuous. A gap in health cover in year three is a gap you’ll be asked about in year five.

Keep the absence log. Both versions share the budget; the EU version is not stricter on absences, but it is the one you’re more likely to use abroad later — where the twelve months outside the EU and six years outside Spain rules start to matter.

Write down your first legal day. Everything counts from there, and it’s the one date people get wrong most often.

If the answer to the question in section 3 is no, most of this list is still worth doing — you’ll just be filing a shorter application at the end of it.

5. What we could not verify, and what we’re sure of

Verified, article by article, in the consolidated text: the five years and the absence budget common to both; the identical procedure and deadlines; the card rules and the fact that a lapsed card doesn’t end the status; the Directive clause in article 175 and its absence in article 182; the resources, cover and 50% student rule of the EU version; the twelve-month EU absence rule common to both and the six-year Spain rule of the EU version; the recovery procedures.

Not verified, and therefore not asserted: how offices count a student stay in a mixed file; whether a national long-term resident can later switch to the EU version without friction — nothing in articles 175-185 forbids it, but we haven’t seen it done and we’re not going to describe a practice we haven’t watched; and how any other member state applies the Directive to someone arriving from Spain.

Where this leaves you

You’re not choosing between a good and a bad permanent residency. You’re choosing between Spain and Europe as the shape of your next decade, and the law lets you choose either — as long as you know by year four which one you’re building towards.

If you’re in years one to three: answer the question in section 3 honestly, write the answer next to your first legal day, and keep the four things in section 4 in order. That’s the whole homework.

If you’re closer than that, or the answer is “maybe” and the file is messy: send us your two dates and your answer to the question.
