Most changes of company don’t break them. The ones that do are predictable

Five years is a long time to work for the same company. Somewhere between your first day and long-term residence, the employer will restructure, the anchor client will end the contract, a better offer will arrive, or a Spanish company will want a piece of what you do. Every one of those is a normal event in a working life — and every one of them touches the thing your residence was granted on.

The phrase to hold on to is in the article that governs your renewal. You may renew for two years at a time as long as the conditions that generated the right are maintained (Ley 14/2013, art. 74 quinquies.3). That’s the test: not are you still remote, not are you still earning, but are the conditions that got you in still there. So the question when a company changes is always the same: which condition does this change touch, and does the new situation still meet it?

Here are the conditions, the changes sorted by whether they break them, and the one obligation that applies whatever the answer.

1. The conditions your residence stands on

There are two kinds of holder on this route, and the law treats them differently from the first article (art. 74 bis.1):

If you’re an employee, you may work only for companies located outside Spain.

If you’re a self-employed professional, you may work for a company located in Spain, as long as that work is not more than 20% of your total professional activity.

And the conditions checked at entry (art. 74 ter) were about the company and the relationship, not just about you: real and continued activity of the company, or group of companies, for at least one year; evidence that the work can be done remotely; and a relationship — employment, or a commercial relationship with one or more companies — over at least the three months before the application, with documents showing the company allows, or the terms of, remote work.

Those are the conditions. Everything below is those conditions applied to a change.

2. The changes, sorted

If you’re an employee and the company that pays you changes

A new employer is a new condition, not a variation of the old one. The way this is handled in practice is a new authorisation on the new relationship, filed with the unit that handles this route (the UGE), and the application itself serves as the notice of the change. The documents are the ones you know — the letter, the contract — for the new company. The published guidance for the route states that the three-month requirement is not asked again of someone who already held an authorisation or visa on this route, because it was already accredited at the time. So the new employer doesn’t need three months of history with you before you file. What the new employer does need is what any employer on this route needs: to be outside Spain, and to show real activity as a company — a start-up founded last month with you as its first hire is a harder file than an established firm, and it’s harder for reasons that are written in article 74 ter.a), not invented at the window.

We’d have the new contract and the new letter reviewed before the resignation letter goes in. The timing that matters is the gap: the old relationship ends, the new one is documented, the filing is made — in that order, without a month in between where you’re an employee of nobody.

If you’re self-employed and your clients change

This is the change that worries people most and requires least. Adding a client, losing a client, replacing your main client: none of those, on their own, is a change of the conditions — you’re still a self-employed professional working remotely for companies outside Spain. There’s nothing to file for a change of client as such. What gets looked at, at renewal, is the whole: that the income across the period stayed above the threshold that applied when you were granted, and that the Spanish share stayed under the line.

That line is the 20%: work for a company in Spain is allowed for a professional as long as it is not more than 20% of your total professional activity (art. 74 bis.1). Treat that as a running ratio, not a year-end surprise. If a Spanish client is growing, know in which month it crosses 20% of the year’s invoicing, and decide before that month — turn the work down, cap it, or accept that this route is no longer the right one and look at the alternatives while you still hold a valid authorisation. What we wouldn’t do is invoice it and hope.

If you switch from employee to self-employed, or back

The published guidance is explicit: proof of a previous employment relationship is not valid to prove a professional relationship, and vice versa. Going from payroll to invoices — the same company, the same work, a different contract — is a change of kind of condition, and it’s treated as a new file, with the three months of the new kind of relationship to show. If a company offers to move you from employee to contractor, the date you accept is the date your three-month clock restarts. Choose it, don’t let it happen to you — and ideally not in the year of a renewal.

If the company moves country, or you do the work from somewhere else for a while

A company outside Spain that moves to another country outside Spain hasn’t touched the condition of being outside Spain. What it may touch is your social security set-up — which country you contribute in, whether the certificate you entered with still applies — and that is a separate condition with its own rules, which we cover in our piece on the certificate of applicable legislation. Working from a third country for a few months is an absence question, not an employer question: the budget in our absence log applies, and the eighteen-month work tier is exactly for this.

3. The obligation that applies to all of them: 30 days

Whatever the change, the law that created this route says two things in one disposition. You must maintain, for the duration of the authorisation, the conditions that gave access to it; and any change during your residence that affects the conditions of admission must be communicated by you to the UGE within 30 days (Ley 14/2013, seventh additional provision, sections 1 and 2). The same provision says what follows if the conditions are found not to be met: the authorisation may be extinguished, with reasons, after a hearing (section 4) — a procedure with a chance to answer, not an automatic switch.

The law doesn’t list which changes are changes affecting the conditions of admission, so the sorting in section 2 is how it’s applied, not how it’s written. The safe reading: a new employer is one (and the new application is the notice); a change of clients as a self-employed professional is not, as such; a change of kind — employee to contractor — is. When a change is on the line, we’d communicate it in the 30 days with a short explanation, rather than debate at renewal whether it should have been. A notice you didn’t strictly need costs a letter. The other mistake costs more.

4. The renewal checks the whole period, not the last month

One last thing, because it changes how you handle the years in between. The renewal on this route is assessed with the same seriousness as the first application, and the central document is increasingly the tax return — what you declared over the period, not what you earn this month. A gap between two employers, a year where the Spanish client quietly reached a third of your invoicing, six months of contributions missing after a change of country: none of those show on the day you file, and all of them show in the papers you file with.

Keep a one-line note of every change of company with its date, what you filed or didn’t, and why. It’s the employer-side twin of the absence log, and it takes the same four minutes.

5. What we could not verify, and what we’re sure of

Verified in the consolidated text: the renewal test of art. 74 quinquies.3; the employee/professional distinction and the 20% rule of art. 74 bis.1; the company and relationship conditions of art. 74 ter; the duty to maintain conditions, the 30-day notice and the extinction-with-hearing of the seventh additional provision. Verified in the published guidance for the route: that the three months are not asked again of a previous holder, and that employment and professional relationships don’t prove each other.

Said as practice, not as law: that a new employer is handled as a new authorisation; that a change of clients as a professional needs no notice as such; that the switch of kind restarts the three months; and that the tax return is the central renewal document. Those are how we see it applied, said without a source, and they can change.

Where this leaves you

Your residence isn’t fragile. It rests on conditions that were written down, and most of the changes a working life brings leave them intact. The three that don’t — a new employer, a change of kind, a Spanish client past the line — are all visible in advance.

If a change is coming and it’s in section 2’s easy half: write the one-line note, keep the ratio, keep the papers.

If it’s a new employer, a switch from payroll to invoices, or a Spanish company on the line: send us the contract or the proposal before you sign it.
